Auckland City, New Zealand Financial Markets Authority Full time

A great place to work. With great work to do.

Ours is a meaningful and impactful role, as a kaitiaki of the financial services in Aotearoa. We oversee a market that does right by everyone, ensuring better outcomes for all New Zealanders. Our role as a kaitiaki is brought to life by our values; Look to the Horizon, Help the Team Work, Make the Calls and Open Hearts, Open Minds.

**Te Tūranga | The Role**

As a Senior Adviser in Perimeter & Response, your role is to consider market participant conduct to assess what, if any, response from the FMA may be warranted to achieve regulatory outcomes. This will include making recommendations to decision makers on the most appropriate regulatory response. Regulatory responses can range from no further action, informal tools such as feedback letters, to the use of regulatory tools (i.e. censures, action plans, direction orders, stop orders, imposing conditions on licences, suspension or cancellation of licences, etc.), or a further referral to the Evidence & Investigations and Enforcement teams to consider opening a formal investigation.

Our remit is very broad. It includes our licensed population within Deposit Taking, Insurance, Advice, Markets, Investors and Reporting sectors. It also includes our perimeter such as fraud/scams, unregistered business, and Anti-Money Laundering and Countering the Financing of Terrorism (AML/CFT).

You will be required to assess, investigate, and resolve suspected misconduct issues or breaches of financial markets legislation in a timely and effective manner and be able to prepare insightful, well-researched reports for decision makers You may have seen some of our high-profile cases reported in the media, such as:

- ** FMA makes permanent stop order against Validus after appeal is dismissed in the High Court | Financial Markets Authority**:

- ** FMA makes permanent stop order to Wisdom House Investment Partners Limited and Yuen Pok Loo**:

- ** FMA warns Du Val Capital Partners Limited over misleading or deceptive statements to investors in the Du Val Mortgage Fund | Financial Markets Authority**:

- ** FMA directs Kalkine to stop making outgoing sales calls to New Zealanders after misleading marketing conduct**:

- ** FMA warns Southern Cross Medical Care Society and Southern Cross Pet Insurance for Financial Markets legislation breaches | Financial Markets Authority**:

- ** FMA censures CTRL for Derivatives Issuer licence breaches | Financial Markets Authority**:

- ** FMA censures Go Financial Solutions for breaching its licence obligations | Financial Markets Authority**

**He kōrero mōu | About you**

You will have significant experience within the financial services industry or in an intelligence-led, risk based regulatory environment as a regulator/investigator at a senior level. You will display knowledge and understanding of financial market participants along with an understanding of governance, risk, audit and compliance assurance (including an understanding of the Financial Markets Conduct Act 2013). You will be naturally curious with an ability to unpick complex problems. In addition, you will support management in the efficient running of the team and give advice on complex issues.

Key to your success in this role will be your:

- Ability to identify and clearly articulate the outcomes that the FMA is seeking to achieve through its regulatory actions and recommend the appropriate response to achieve those
- Exceptional interpersonal, communication, and influencing skills.
- Strong written communication skills with a proven ability to produce high quality documents that present information clearly and concisely.
- Agility and resilience, and ability to maintain momentum with a strategic focus.

**Ngā painga | What we offer**

We offer some great benefits including a 4% KiwiSaver contribution, health and life insurance cover, paid leave over the Christmas period, a generous $1,500 refer a friend bonus as well as an ability to swap public holiday leave with other days that mean more to you.
